 Trade Promotion: Conditions of Entry for a 2023St. Kilda Football Club signed Guernsey - April 2023

 

KEY INFORMATION

This information should be read in conjunction with all of the Terms below:

  • The five (5) prize winners will each receive a 2023St. Kilda Football Club signed Guernsey (the Prize).
  • The Promotion will run between 10am Friday, 21 April 2023 and 5pm on 18 May 2023 (Promotion Period).
  • Eligible Entrants refers to persons who have entered the Promotion:
  • over the age of 18;
  • resident of a State or Territory of Australia: Victoria, New South Wales, South Australia, Tasmania, Northern Territory, Western Australia, Australian Capital Territory, and Queensland; and
  • who hold a currentSt. Kilda Football Club membership.
  • Number of prizes: five (5).
  • The total prize pool for the Promotion is valued at AUD$3,000 as at 20 April 2023.  
  • No permit was required to be obtained for this Promotion. 
  • Once the five (5) winners’ identity, address and age have been verified in accordance with clause 16, the Promotional Participant will within seven (7) days of close of the Promotion Period or such earlier time as is decided by the Promoter:
  • notify the winners by telephone and by e-mail; and
  • cause the winners’ details to be published to the Promoter’s Electronic Direct Marketing Data base or on the Promoter’s website.

PROMOTER

  1. The Promoter isSt. Kilda Football Club Limited ofSt. Kilda Centre, Corner of Olympic Boulevard & Batman Avenue, Olympic Park, Melbourne VIC 3000 (Promoter). La Trobe Financial Services Pty Limited (La Trobe Financial) is an officialSt. Kilda partner (Promotion Participant).
  2. This document contains the terms and conditions of entry (Terms) into the Promotion.
  3. Entry into the Promotion is deemed acceptance of the Terms.
  4. Eligible Entrants are responsible for ensuring their familiarity with the Terms at the time of participation.  The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of the Terms generally. 

HOW TO ENTER

  1. To enter the Promotion, Eligible Entrants must, during the Promotion Period invest a minimum of AUD$10,000 in the La Trobe Financial 12 Month Term Account and provide La Trobe Financial with details of their currentSt. Kilda Membership.
  2. Existing or new members of the La Trobe Australian Credit Fund (Credit Fund) are eligible to enter the Promotion.
  3. Eligible Entrants will receive one (1) entry into the Promotion.
  4. All entries become the property of the Promoter and La Trobe Financial.

CONDITIONS OF ENTRY

  1. All entries must be received by La Trobe Financial during the Promotion Period.
  2. Eligible Entrants must read and agree to the terms of the Credit Fund’s Product Disclosure Statement (PDS) prior to investing. Eligible Entrants may also wish to consider the Target Market Determinations on La Trobe Financial’s website to assist with deciding whether an investment in the 12 Month Term Account is suitable for their needs and circumstances.
  3. Investors in the 12 Month Term Account who hold an activeSt. Kilda Football Club membership will be entitled to receive 0.25% above the advertised rate of return on their investment (refer to La Trobe Financial’s website). This offer is subject to change and may be withdrawn by La Trobe Financial. Eligible Entrants will not be able to earn Qantas Frequent Flyer Points on their investment into the Credit Fund if they are participating in this Promotion.
  4. Investments into the Credit Fund must be a new investment of AUD$10,000 or above into a new or existing 12 Month Term Account held by the Eligible Entrant. Transfers from another investment account in the Credit Fund to the 12 Month Term Account will not qualify for entry into the Promotion.
  5. An Eligible Entrant may only enter as an individual and must be a member of theSt. Kilda Football Club. Evidence of membership will be required to be produced to La Trobe Financial when the Entrant makes their investment.
  6. Eligible Entrants exclude employees of the Promoter and other agencies, firms or companies associated with the Promotion, and their immediate families.  Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  7. The Promoter, subject to the relevant Australian State or Territory legislation, reserves the right not to accept an entry from any Entrant or to disqualify an Entrant if the Promoter considers that the entry contains anything defamatory, is otherwise inappropriate, is not submitted in accordance with these Terms, or is received after the closing date. 

SELECTION OF WINNERS

  1. The winners will be the first five (5) Eligible Entrants that invest in La Trobe Financial’s 12 Month Term Account and that produce evidence of theirSt. Kilda Football Club membership to La Trobe Financial’s satisfaction.  
  2. After the winners are successfully contacted, the winners must within three (3) days confirm in writing to the Promoter their residential or postal address to receive the Prize. Postage and handling costs will be paid by the Promoter.
  3. In the event that any of the winners are non-contactable the unclaimed Prize will be withdrawn.
  4. The Prize remains the property of the Promoter until claimed by the respective winner.
  5. The Promoter and La Trobe Financial’s decision in relation to any aspects of the Promotion is, subject to relevant Australian State or Territory legislation, final and binding on every person who enters and no correspondence will be entered into.  At all times, Eligible Entrants agree to act in accordance with the Promoter's Terms and Conditions and La Trobe Financial’s Privacy Policy (available at www.latrobefinancial.com/home/privacypolicy).
  6. The Prize is not transferable or exchangeable.

GENERAL

  1. Neither the Promoter nor La Trobe Financial (or any of its related bodies corporate as defined under the Corporations Act 2001) shall be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any entry or Prize except for any liability which cannot be excluded by law.
  2. The Promoter and La Trobe Financial reserves the right to verify the validity of applications into the Credit Fund including an Eligible Entrant’s identity, age and place of residence.  The Promoter and La Trobe Financial reserve the right, subject to relevant Australian State or Territory legislation, to disqualify any Entrant for tampering with the application process or for applying which is not in accordance with these Terms.
  3. The Promoter and La Trobe Financial are neither responsible nor liable for any late, lost or misdirected applications into the Credit Fund and all entries are deemed to be received at the time of receipt of the application into the Promotion database and not the time of transmission by the Eligible Entrant.  The Promoter, subject to relevant Australian State or Territory legislation, assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of applications.
  4. Incomplete, indecipherable and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
  5. It is a condition of taking a Prize that the Winner must, if requested to do so by the Promoter, sign and return documents relating to their eligibility to enter the promotion.
  6. By participating in the Promotion, Entrants agree and acknowledge that:
    (a) they may be contacted by the Promoter or La Trobe Financial to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos of them;
    (b) the Promoter or La Trobe Financial may use such comments or photos (the Materials) for the Promoter’s future promotional and marketing purposes without seeking their further consent or providing compensation to them;
    (c) the Promoter or La Trobe Financial may duplicate, alter, adapt and utilise the Materials in such a manner as the Promoter wishes at anytime, anywhere, and by any means.  The Promoter or La Trobe Financial may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
    (d) the Promoter and La Trobe Financial retain all right, title and interest, including copyright, in the Materials and, by participating in the Promotion, they assign to the Promoter on creation of the Materials all right, title and interest which might, but for these Terms, vest in them;
    (e) they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent if given (Moral Rights); and
    (f)  they waive all Moral Rights in the Materials that arise outside Australia; and they agree not to institute, maintain or support, any claim or proceeding for infringement of their Moral Rights in the Materials.
  7. In order for Eligible Entrants to participate in the Promotion, the Promoter and La Trobe Financial may collect the name, age, email, address and telephone number of each Entrant (Personal Information).  The privacy of each Eligible Entrant is important to the Promoter and La Trobe Financial and all Personal Information will be kept securely and confidentially.  All personal information provided by an Eligible Entrant will be used by the Promoter and La Trobe Financial and on behalf of selected third parties in accordance with its Privacy Policy.  This may include for promotional and direct marketing purposes and other disclosures as specified in La Trobe Financial’s Privacy Policy which is available at www.latrobefinancial.com/home/privacypolicy.
  8. If the Personal Information requested is not provided, or the Entrant does not consent to their Personal Information being used for the above primary purpose, the Entrant should not participate in the Promotion. By entering the Promotion, the Entrant understands and agrees that the Promoter and La Trobe Financial may disclose the information provided by the Entrant to a lottery regulator (if necessary), publish the winner’s name as required under relevant legislation, as well as use their Personal Information for further promotional, marketing and publicity purposes
  9. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  10. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the prize and any costs incurred by Eligible Entrants in entering the competition is borne by the Eligible Entrant.
